Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Selva (the “Service”), a startup and investor intelligence platform operated by mAI Depot, Inc. (“mAI Depot, Inc.,” “we,” “us,” or “our”) at selva.vc. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
Selva aggregates and organizes publicly available information about Latin American startups, investors and funding activity, together with derived analysis and infographics. The Service is provided for informational and research purposes only.
No investment advice. Nothing on the Service constitutes investment, financial, legal, tax or other professional advice, an offer or solicitation to buy or sell any security, or a recommendation regarding any company or transaction. You are solely responsible for your own decisions and should consult qualified professionals. No accuracy guarantee. Data is compiled from third-party sources and automated processes and may be incomplete, out of date, or inaccurate. We do not warrant the accuracy, completeness or reliability of any information on the Service.3. Accounts
Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use.
4. Subscriptions, Billing and Refunds
Premium features are offered on a paid subscription basis (currently $39 per month or $390 per year, subject to change). Payments are processed by our third-party payment processor, Stripe, Inc.; we do not store your full payment card details.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price until cancelled. You authorize us and Stripe to charge your payment method on each renewal. Cancellation. You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.5. Acceptable Use
You agree not to: (a) scrape, crawl, harvest, or bulk-download the Service or use it to build or train a competing dataset or product; (b) resell, sublicense, or redistribute data from the Service except as expressly permitted; (c) circumvent access controls, rate limits, or paywalls; (d) misuse contact information obtained through the Service, including for unlawful, deceptive, or unsolicited bulk communications; (e) upload malware or interfere with the Service’s operation; or (f) use the Service in violation of any applicable law.
6. User Submissions
The Service may let you submit content such as data corrections, edit requests, and pitch materials (“Submissions”). You retain ownership of your Submissions, but you grant mAI Depot, Inc. a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your Submissions to operate, improve, and provide the Service. You represent that you have the rights to make each Submission and that it does not infringe or violate any third party’s rights or any law. Do not submit confidential information you are not authorized to share.
7. Intellectual Property
The Service, including its compilation of data, software, design, and branding, is owned by mAI Depot, Inc. or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable license to access and use the Service for your internal, non-commercial or internal business purposes. All rights not expressly granted are reserved.
8. Third-Party Services and Links
The Service relies on and links to third parties (including Google Firebase, Stripe, and Cloudflare) and to external websites we do not control. We are not responsible for third-party content, products, or practices, and your use of them may be subject to their own terms.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAI DEPOT, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to indemnify and hold harmless mAI Depot, Inc. from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Submissions, or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in the State of Delaware for any dispute not subject to arbitration, and waive any objection to venue there.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date, and your continued use of the Service after changes take effect constitutes acceptance.
